<p dir="RTL">הזמנתי מונית ומיד בסוף שיחת הטלפון עצר לי שכן שנסע לאותו כיוון, האם אני רשאי לבטל?</p>

<p dir="RTL">יש לבדוק האם הגרם הפסד לנהג מונית? ההפסד שנלקח בחשבון הוא אפשרות שהייתה הזמנה חדשה שבעל התחנה סירב לקבל בגלל שכל המוניות תפוסות. במציאות בשדרות, הדבר לא כל כך קיים כי בדרך כלל יש מספיק מוניות לכל הפניות. אומנם כאשר אין שום הפסד לבעל המונית מותר לחזור בו אולם ראוי לו לאדם לעמוד בדיבורו, בלשון המשנה הדבר מוגדר כ&#8221;תרעומת&#8221; מעין הקפדה שיש לנהג מונית על הנוסע.<br />
שיקול נוסף שאותו צריך לקחת בחשבון הוא האם נהג המונית יצא כבר לדרכו? ההלכה מלמדת אותנו שכאשר הפועל התחיל בעבודתו או התחיל ללכת למקום עבודתו אז יש בעיה לחזור מההזמנה.<br />
לכן צריך להעריך כמה זמן עבר משעת ההזמנה ועד שעת הביטול [בשדרות ניתן להעריך סביב החמש דקות] ורק אם לא התחיל בנסיעה, לבטל</p>

<p dir="RTL">הדבר תלוי מהי  ההתקשרות בין העובד והמעביד. אם סיכמו בעל פה בלבד ולא נחתם שום חוזה אז <strong>יכול </strong>המעביד לחזור בו. אולם אם העובד,באופן ברור הפסיד עבודה אחרת, חייב המעביד לפצות את העובד.<br />
למשל אדם סיכם עם מורה שיתן שיעורים פרטיים לבן שלו. המורה קיבל הצעות נוספות לעבודה והוא דחה אותם בגלל המחויבות לסיכום. לבסוף האב התחרט והודיע למורה שהוא חוזר בו מהסיכום, המורה זכאי לקבל פיצוי על הפסד העבודה שנגרם לו [בתנאי שאכן הוא הפסיד אותם ואין לו אפשרות ללמד עכשיו].<br />
גם אם לא נגרם הפסד למורה יש לו עוגמת נפש ולכן לא כדאי לחזור סתם מסיכום. המשנה בפרק שישי בבא מציעא קוראת להקפדה הזו &#8220;תרעומת&#8221;, הכוונה להקפדה מצד העובד כלפי המעביד. ברגע שיש למעביד סיבה טובה לחזרה כגון הפסד כספי או הצעה של עובד טוב יותר אז אין אפילו תרעומת. וכן אם העובד מוצא מיד עבודה חילופית ולא נגרם לו הפסד ,אין תרעומת.<br />
אם העובד כבר התחיל את עבודתו או שנחתם חוזה בין הצדדים אז מידת האחריות של המעביד גדולה ולכן יצטרך לשלם יותר.</p>
