								<content:encoded><![CDATA[<p>אריק הוא נער עם חוש לעסקים. לקראת פסח הוא פותח &#8216;חברת נקיון&#8217;.הוא תולה מודעות מושקעות על נקיון מעולה לפסח תמורת 35 ש&#8217;ח לשעה וברוך ה&#8217; הפלאפון לא מפסיק לצלצל. הסיכום של אריק עם הנערים שאותם שלח לעבוד היה, שמתוך 35 שקל לשעה שהם מקבלים הם מפרישים עבורו 10 ש&#8217;ח לשעה.<br />
יום אחד מקבל אריק טלפון עם בקשה לעובד נקיון למחר למשך שמונה שעות.<br />
אחרי שמונה שעות העבודה בקש בעל הבית מהנער להמשיך לעוד ארבע שעות עבודה וכן לבוא מחר לנקות לו את המשרד.<br />
למחרת, לאחר ששילם בעל הבית לעובד את שכרו התעורר ויכוח בין אריק לבין העובד. העובד טען שהוא צריך לשלם דמי תיווך רק עבור 8 השעות שאליהם נשלח על ידי אריק ועל שאר השעות כל השכר הולך אליו. אריק טען שעבור כל שעות העבודה כולל נקיון המשרד מגיע לו 10 ש&#8217;ח לשעה דמי תיווך.<br />
שאלו את הרב עם מי הדין וזו תשובתו: היות וזה הוא דבר מצוי שמזמינים עבודה לקצת שעות ועם הזמן מגלים שיש צורך להוסיף שעות עבודה , לכן גם השעות הנוספות כלולות בעסקת התיווך ויש להפריש עבורם דמי תיווך. לעומת זאת לגבי נקיון המשרד היות ומדובר על מקום חדש זו עסקה חדשה שלא הגיעה דרך אריק ואין צורך להעביר עליה דמי תיווך.על אף שבצורה עקיפה נוצרה הנאה מהתיווך של אריק אך עליה לא היה סיכום מראש ולכן אין אפשרות לדרוש עליה תשלום.</p>

<p dir="RTL"><strong>הרחבה</strong></p>
<p dir="RTL">דינו של מתווך דומה לדין יורד לשדה חבירו והשביחו (באור בגר&#8221;א סימן קפ&#8221;ה).העברת המידע לעובד היא פעולת תיווך שיש לשלם עליה ככל הנאה שמקבלים מאדם אחר (רמ&#8221;א רס&#8221;ד ד). בוודאי שכאשר ישנה פסיקה מראש על מחיר התיווך צריך לשלם כפי שסוכם. ההנאה מהתיווך כוללת את כל שעות העבודה שנגרמו ישירות מהתיווך. לכן כל עוד לא סוכם אחרת הרי הפועל חייב לשלם למתווך את שכרו על פעולת התיווך. אולם אם התיווך הסתיים הן מצד מה שדובר והן מצדהמציאות שאין עבודה באותו דבר הרי אין זכות למתווך לקבל שכר על מה שנגרם בעקיפין מהתיווך שלו (שו&#8221;ת אבני נזר חו&#8221;מ סימן ל&#8221;ו).</p>
