<p>הסוכר נשאר ממון של המוכר משום שאת לא רצית לזכות בסוכר. אם כך ניתן לראות בסוכר ממון של המוכר המזיק לעוף שלך.<br />
הרב שלמה זלמן אויירבך זצ&#8221;ל חייב במקרה כזה [מנחת שלמה בבא קמא דף ו ].<br />
הוא דימה את הדין הזה לדברי הגמרא על &#8220;בור המתגלגל ברגלי אדם&#8221;. כאשר המוכר אומר על סוכר שהוא מלח בכך הוא נחשב ל&#8221;חופר בור&#8221; אלא שהבור שלו הועבר לתוך הבשר ושם הוא הזיק. דוגמא נוספת- אדם המניח אבן בראש הגג והיא נופלת לארץ ואז אדם נתקל בה וניזוק, זה הוא דין בור, כך גם הסוכר.</p>
