<p dir="RTL">אני גר בקומה רביעית, החלטתי לחבר למעקה של המרפסת שלט בחירות גדול. לאחר כמה ימים השלט נפל ופגע ברכב חונה, לרכב נגרם נזק של 850 ₪ , האם אני חייב לשלם?</p>

<p dir="RTL">אדם מחוייב לשמור על הממון שלו שלא יזיק. רמת השמירה נקבעת לפי תנאי המקום. בקומת קרקע מספיק להדק שלט למעקה על ידי קשירה של חוטים לעומת זאת בקומה רביעית צריך להתחשב בכוח של הרוח ולכן יש להדק את השלט בחוזקה על ידי אזיקונים וכדומה.</p>
<p dir="RTL">בגמרא הדבר מנוסח כדרישה מהאדם לספק שמירה שעומדת ב&#8221;רוח מצויה&#8221; [בבא קמא פרק הכונס].</p>
<p dir="RTL">לכן אם באותו יום שנפל השלט היה מזג אויר חורפי הרגיל בשדרות , עליך לשלם ! אולם אם הייתה סערה לא רגילה ובגללה נפל השלט , אתה פטור.</p>
