<p dir="RTL">הסתובבתי עם עגלת קניות בסופר ולפתע העגלה נתקלה בחריץ ברצפה וכתוצאה מכך נפלתי ונשברה לי האצבע. נגרם לי נזק לטווח ארוך היות והאצבע לא מתפקדת. בבירור שעשיתי עם הנהלת הסופר התברר שאין להם ביטוח המגן מפני תקלות.</p>

<p>כבר כתבנו כמה פעמים שבשאלות מעין אלו צריך לשמוע את שני הצדדים שהרי אפשר שישנם טענות המשנות את כל התמונה כגון  שהחריץ הזה נפער ממש לאחרונה ועוד לא היה מספיק זמן לתקן אותו. מכל מקום נדון בעיקר הדבר ללא קשר למקרה הזה.<br />
אדם שיש לו תקלה בחצירו והוא נותן רשות לאחרים להיכנס לשם הרי הוא חייב בתשלום הנזק.<br />
&#8220;אחד החופר בור ברשות הרבים, או החופר בור ברשותו ופתחו לר&#8221;ה, אם הוזק בו אדם, חייב נזק שלם&#8221; (שולחן ערוך חושן משפט סימן תי)<br />
החיוב קיים רק אם האדם חפר את הבור או שידע מקיום התקלה ולא כיסה אותה אבל אם <strong>לא</strong> נודע לו מקיומה של התקלה, על אף שזה ברשותו, הרי הוא אנוס ופטור.</p>
