<p dir="RTL"><strong>בירור הדין</strong>&#8211; הכלל הוא &#8220;<span style="text-decoration: underline;">זה נהנה וזה לא חסר -פטור</span>&#8221; .כאשר ישנה הנאה לאדם מנכסי חבירו ללא שום הוצאה כספית מחודשת אז אין סיבה לתבוע תשלום. לדוגמא אדם ישן במרפסת של חבירו ללא רשות, אין אפשרות לתבוע ממנו תשלום. הוא לא החסיר את בעל המרפסת ולא גרם לו הוצאות כספיות.<br />
האם כאשר הצטרף לנסיעה אדם נוסף, האם הוא גרם להוצאה כספית חדשה?<br />
המשקל של הנוסע אכן משפיע בדבר מועט על צריכת הדלק [מלבד מקרים אשר נפח המנוע גדול].<br />
ברגע שישנה הוצאה כספית הרי האדם מתחייב לשלם על הנאתו שכן &#8220;זה נהנה וזה חסר חייב&#8221;.<br />
בגמרא מסופר על אדם שפלש לחצר חבירו וגר שם תקופה, לבסוף בעל החצר הצליח להוציא אותו והוא נאלץ לשלם שכירות.התברר שהקירות של החצר הושחרו מחמת השימוש אם כן ישנו הפסד כספי וממילא הוא חייב לשלם.לכן יש צד מסוים לחייב את הנוסע בטרמפ בתשלום.<br />
אולם למעשה נראה שאין לחייב את הנוסע ,הסיבה היא מחילה של הנהג על התשלום. כאשר אדם עוצר טרמפ הוא מכריז אני רוצה לנסוע <strong>ללא תשלום</strong>, כל מי שעוצר ומעלה אותו <span style="text-decoration: underline;">על דעת כך הוא פועל</span> וממילא אין אפשרות בסוף הנסיעה לשנות את התנאים ולדרוש תשלום.</p>
