<p dir="RTL">אחד מדיירי הבניין עבר דירה והשאיר מכונת כביסה ליד המדרגות של הבניין. ועד הבית ניסה להשיג אותו בטלפון ,ללא הועיל. לאחר חודש, ועד הבית נתן את המכונה ללא תשלום לחנות &#8220;יד שניה&#8221;, תמורת הפינוי שלה .הדייר תובע את מחיר המכונה מועד הבית .</p>

<p dir="RTL"><strong>בירור הדין-</strong> חדר מדרגות הוא רכוש משותף לכלל הדיירים ולכן חלים עליו ההלכות של שותפים.</p>
<p>צורת השימוש בנכס המשותף היא <span style="text-decoration: underline;">בהתאם למקובל באותו מקום</span> , כפי שכתב השולחן ערוך &#8221; אחד מהשותפין בחצר שבקש להעמיד בה בהמה או ריחים או לגדל בו תרנגולים, חבירו מעכב עליו, וכן שאר דברים שאין דרך בני המקום לעשותם בחצרותיהם, בכולם השותפין מעכבין זה על זה&#8221;.<br />
המנהג המקובל אינו מאפשר לדייר להשאיר חפצים לאורך זמן בחדר המדרגות, מלבד אופניים ועגלות. לכן אין אפשרות להשאיר שם חפץ במשך חודש שלם, והדייר עבר על כללי השימוש בנכס המשותף. <span style="text-decoration: underline;">האם ועד הבית נהג כשורה כאשר מכר את המכונה ללא רשות?</span><br />
נראה שוועד הבית נהג בפזיזות יתירה, הוא נתן את המכונה ללא תמורה על מנת לזרז את הפינוי שלה.<br />
ההלכה מתירה לאדם להתגונן ולשמור על רכושו אבל עליו לבדוק שהוא עושה רק את המינימום האפשרי. ועד הבית היה רשאי למכור את המכונה במחיר מלא ולהעביר את הכסף לדייר.אפשרות נוספת היא להוציא את המכונה החוצה לרחוב ואז הייתה הזדמנות לדייר ליטול משם את המכונה. כך נפסק בשולחן ערוך : &#8220;מי שהכניס פירותיו לבית חבירו שלא מדעתו, או שהטעהו עד שהכניס פירותיו והניחם והלך, יש לבעל הבית למכור לו מאותם הפירות כדי ליתן שכר הפועלים שמוציאין אותם ומשליכים אותם לשוק&#8221;. לכן על ועד הבית לפצות <span style="text-decoration: underline;">במקצת</span> את הדייר.</p>
