<p dir="RTL">הכנסתי את הבן שלי לגן תורני באיחור, לכן לא התבצע הנוהל הרגיל של הרשמה לגן. לאחר כחודש ביקשו ממני תשלום עבור רב הגן, אני לא רוצה לשלם בטענה שלא דובר עמי מראש על כך.</p>

<p dir="RTL">בדרך כלל אי אפשר לחייב אדם לשלם על דבר שלא סוכם עימו מראש. אולם כאן יש לדון האם ישנו מנהג קבוע לגבות תשלום מההורים עבור רב הגן. אם אכן כך המנהג  בכל הגנים התורניים לממן את הפעילות המיוחדת על ידי ההורים אזי <strong><span style="text-decoration: underline;">כולם</span></strong> חייבים בכך. כך למדנו בשולחן ערוך [חושן משפט סימן מ&#8221;ב] דבר שהוא מנהג, אף על פי שלא נכתב דנים אותו כאילו הוא נכתב. לכן גם אם לא ידעת על חובת התשלום עליך לשלם משום שזה הוא המנהג הפשוט בכל הגנים מהסוג הזה.</p>
