<p align="right">ראובן הוא בעל חנות בשדרות ,לקראת הקיץ הוא חיפש עובד נוסף. הוא חתם חוזה עם שמעון. לאחר חודש עבודה התחילה מתקפת הקאסם על העיר. עקב המצב ישנה ירידה משמעותית במכירות ולכן אין צורך בעבודתו של שמעון. ראובן לא יכול להרשות לעצמו להחזיק עוד עובד, אף אם המצב יחזור לשגרה, הוא מבקש לפטר את שמעון. לעומתו טוען שמעון- היה לי אפשרות לעבוד בעבודה אחרת מחוץ לעיר ועכשיו הפסדתי אותה.</p>

<p align="right"><strong>בירור הדין</strong>&#8211; ראשית יש לבדוק את החוזה, האם יש בו סעיף העוסק בנושא של פיטורין?<br />
במידה וישנו סעיף כזה הוא המכריע ,יש לו תוקף הלכתי.התורה מאפשרת למעביד ולעובד לקבוע בניהם את ההסכם המתאים להם [בתנאי שאין בעיה של ריבית].<br />
במידה ואין התייחסות בחוזה אז הכלל הבסיסי- אין לפטר עובד באמצע הזמן שסוכם עליו. אולם אם המעביד <strong>אנוס </strong>הוא רשאי לחזור בו. בגמרא בפרק שישי בבא- מציעא מסופר על חקלאי ששכר פועלים להשקות את שדהו לבסוף ירד גשם והשקה את השדה.המעביד <strong>פטור</strong> מתשלום היות ואין לו צורך בפועלים. גם במקרה שלנו המעביד אנוס אין לו צורך בפועל ולכן הוא <span style="text-decoration: underline;">רשאי</span> לחזור בו מההסכם.<br />
הפועל טען שנגרם לו נזק, הוא הפסיד עבודה.אף על פי כן המעביד פטור מכל תשלום היות והוא אנוס. הוא לא התכוין להזיק  המצב מאלץ אותו לפטר את העובד, לכן אין לו אחריות על ההפסד שנגרם לפועל.</p>
